Cites Serious Violations by CPS District Against Xiao Ying Zhang & Husband

New York City - On January 6, I obtained email correspondence from one of the leading immigration attorneys in the United States regarding the December 12 news story "Xiao Ying's War". The article focused on allegations made by
China natives Xiao Ying Zhang and Howard Wang against the Cincinnati Public School District involving corrupt hiring practices, a campaign of harassment against Wang and serious immigration and employment policy violations. Having practiced immigration law for 30 years and counting, Gordon Quan, Co-Chair and Partner with the firm FosterQuan, LLP, is regarded as an expert by many of his peers and associates. This being the case, Munson Kwok, President of the Chinese American Citizens Alliance, an organization that seeks to promote Chinese culture and defend the civil rights of Asian people, contacted Quan after reading the article and requested that he comment on the dire situation facing Xiao Ying Zhang and her family. The renowned attorney complied by providing the following statement:

"Thank you for forwarding the information on Ms. Xiao Ying Zhang's case to the Chinese American Citizens Alliance. The matter has been raised at our December 20th meeting and President Munson Kwok has asked me to respond in that I have been practicing immigration law for over 30 years. The plight of Mr. Wang and Ms. Zhang is certainly sympathetic but not totally unusual. As a temporary worker on an H-1B visa, Mr. Wang is obligated to work for the sponsoring employer on the terms and conditions set forth on the non-immigrant visa petition. As an H-lB sponsor, the petitioner warrants to the Department of Labor (DOL) that they will employ him in the position requested and pay him the salary stated for the hours to which they have committed. The United States Citizenship and Immigration Services (USCIS) grant the petition on this basis. The petition is generally granted for up to three years and may be extended for a period not to exceed three more years.
