When the Right to Privacy Protects Wrongdoers, It's Time for Change

Even Thieves Can Hide Their Identity by Asserting Privacy Rights

In the past few years, I have been besieged with obstructions masquerading as "privacy rights protections." These obstructions have prevented me from obtaining information necessary to protect myself and my family from people who were violating our rights, even committing crimes against us. Our lawmakers' obsessions with legislating privacy rights have gotten out of hand. Let's stop protecting wrongdoers from theoretical retaliation and instead identify them to the people they wrong so that justice can be had.

Here's a recent example: for three weeks, some teenage pranksters have been calling my home. If someone answers the phone, they shout, "You're a M-----F----, you A-H---" and other warm greetings. If no one answers, they leave their sentiments on the answering machine where my young children might retrieve the message. At first I thought this problem would resolve on its own, but after three weeks, it has escalated. Now the boys are ordering pizzas sent to my house-in addition to shouting obscenities into my phone.

Takeaways
  • The phone company can't release traced numbers to the person being harrassed.
  • Schools refuse to tell parents of children injured by classmates the outcome of their complaint.
  • The bank will not release the identity of the thief who steals your money.
Did You Know?
I am in favor of privacy rights! But somehow our society's interpretation of the right to privacy when it comes to wrongdoing has gotten out of hand.

You've eloquently presented one of my biggest 'tooth-grinding' frustrations! The bad guys do get away with bullying all the time. I'm a high school teacher, and it goes right to the top of authority. It's impossible to maintain a mutually respectful environment and everyones' responsibilities for their own behaviors, when constant truancy, documented for months, only gets the kid one lunch detention. Big incentive to change that behavior -NOT!

Things like this are exactly why I ran for President in 2000 and 2004, and will again in 2008. In a society where criminals have more rights than their victims, it's obvious that government as we no it no longer works and it's time for a change. The evil and those with money (often the same people) have all the rights. Honest people have the fruit of the raspberry bush.

Ridiculous all the way around. I hope the prank-calling ends immediately.

Privacy laws are meant to keep people from stalking us and getting our personal information, but unfortunately they get twisted to protect criminals from their victims. It sucks. I'm sorry all this stuff happened to you. Good article, though.

That's strange and scary.

It's a neverending cycle -- we run into the "privacy" roadblock, which makes us more afraid to be open with each other, which makes it more possible for others to commit fraud and hide behind the privacy roadblock! It seems that in our culture, we can add "privacy" to "the love of money" as a root of all kinds of evil.

Absolutely. I had identity fraud committed against me and I was treated like the perp. Im sorry, what's wrong with vigilantes? The thought grows more appealing by the day. Great article.

Interesting points you've made. My mother had the same problem and suspected it was girls from my teen sister's school. She also, wanted to handle it "parent-to-parent" but since the calling offenders were blocking their number, she had to make it a police matter PLUS pay to get her number changed. It's a case of the victim being double victimized. Wish you luck getting yours resolved!

Amen. I'm sorry all this has happened though :( It's a sick world we live in.

I'm with you on wanting to know that problems are resolved. At the very least information should be given on how the problem has been taken care of and resolved. Hope your current prankster situation comes to a quick close soon! Rest in knowing, what goes around really does come around- those ignorant pranksters will suffer in the end.

Tricky wicket, this.

Interesting but depressing and scarey at the same time. Well done!
