The New Mexico Clean Indoor Air Act is the result of the New Mexico State Legislature to protect its people from the dangers created by smoking tobacco products and second-hand smoke. The New Mexico Clean Indoor Air Act, also known as The Dee Johnson Clean Indoor Air Act, is one big step taken by the New Mexico State Legislature, which states where smoking is prohibited and where smoking is permitted. This Clean Indoor Air Act also states what penalties can occur from violations of the act.

The amendment to New Mexico's Clean Indoor Air Act, that changed the name to The Dee Johnson Clean Indoor Air Act, also changed where designated smoking areas were located. Prior to this amendment being passed, smoking was prohibited, except in designated smoking areas, in public places, which are defined as "any enclosed indoor area in a building owned or leased by the State of New Mexico or any of its political subdivisions", or public meetings which are defined as "any meeting required by law to be an open meeting." This act also stated that all areas of the state capitol or capitol north were smoke-free. The amendment changed where smoking was prohibited by having all designated smoking areas in public places and public meetings taken out, making them totally smoke-free, as well as making public transportation smoke-free. According to The Dee Johnson Clean Indoor Air Act, smoking is also prohibited "near entrances, windows and ventilation systems of workplaces and public places." The act goes on to state that smoking is prohibited in theaters, auditoriums, restaurants and other work places.

Proprietors of the locations affected The Dee Johnson Clean Indoor Air Act must have the appropriate signs posted to inform smokers where they can and cannot smoke legally. These signs should be posted at the entrances to the establishments and located where they are clearly visible.
