The Benefits of a Prenuptial Agreement

Prenuptial agreements are pragmatic rather than romantic. The agreement can offer a measure of comfort to both parties in a betrothed couple because the agreement spells out the division of assets in the event of divorce. Hopefully both parties are entering a marriage in good faith, but sadly it is not all that uncommon for people to marry for money or power. There are also people who enter into prenuptial agreements in bad faith. For example, they may state that there will be a financial settlement if the marriage lasts a certain number of years, with no intention of letting the marriage last that long.

A prenuptial agreement can help to offer some protection against fraud and deception for people who have assets to protect. They can also offer a measure of protection to the spouse with less assets going into the marriage but who invest a substantial portion of their life and time into the marriage.

Prenuptial agreements are contractual agreements made in advance of the marriage, usually in regard to the division of assets in the event that the marriage ends in divorce. The prenuptial agreement sounds like the anti romance, but can be very practical, especially when one party is much wealthier than the other or when both spouses have substantial wealth or assets.

The prenuptial agreement can offer protection to both parties of the agreement. The person with the higher level of assets can benefit from the feeling of assurance that the other is not marrying for money. They also benefit from the assurance that they assets have a measure of protection in case the marriage heads south.

The party with fewer assets can also benefit from a prenuptial agreement because it spells out in advance what their financial settlement will include and offer them some assurance that they will be cared for if the marriage ends.

Prenuptial agreements can also cover assets that have not come into the marital estate will be covered. An example would be an inheritance that comes to one of the parties.
