A woman with a cancerous brain tumor has lost her Court appeal for use of marijuana to alleviate the pain and suffering caused by her disease.

Federal Appellate Judges in San Francisco ruled Wednesday that a terminally ill woman was not immune to federal prosecution for marijuana use. In a separate case, a federal judge dismissed most the charges against a advocate of the medicinal use of marijuana, reported the New York Times.

Angel McClary Raich claims that she used marijuana as recommended by her doctor. She has an inoperable brain tumor, along with other serious ailments. Angle Raich, 41, says that marijuana stimulates her appetite and relieves pain more effectively than prescription drugs.

Ms Raich wept when she heard the court decision. New York Times reported that Ms Raich said said "It's not every day in this country that someone's right to life is taken from them. Today you are looking at someone who really is walking dead."

Ms. Reich and three other plaintiffs sued the government for federal laws outlawing marijuana in 2002. The case made it to the Supreme Court. In 2005 the Supreme Court ruled against Ms. Raich, when the found that theyh Federal government had the authority to prohibit and prosecute possession the use of marijuana for medical purposes. The Supreme Court Justices left elements of the case to a lower court to consider.

On Wednesday, a three-judge panel of the United States Court of appeals for the Ninth Circuit ruled that while they were sympathetic to Ms. Reich's plights and while they had seen "unconverted evidence" that she needed marijuana to survive, she did not have legal grounds to exempt herself from Federal law, \accorded to New York Times (nytimes.com). quotes from the decision read that, "The court "recognizes the use of marijuana of medical purposes is gaining traction, but that legal recognition has not yet reached the point were a conclusion can be drawn that the right to use medical marijuana is 'fundamental'."

Marijuana really isn't that bad for you... I don't understand why it isn't legalized. If it was in fact legalized, at least pharmaceutical companies could distribute it to the public legally, so there would be less danger to its users. Great article. I hope her appeal makes it and she finally wins the case.

I hope the judge never has to suffer like Ms.Raich because god knows if he him self had a brain tumer, he would do what ever it took to relieve his pain!SHAME ON YOU.

In this area, the law is not fair and equitable. Other substances - opium, codeine, amphetamines - are illegal to possess without a prescription, but the law does not prevent them from being used medicinally. Why should marijuana be an exception?

What is wrong with these people? There are worse things this woman could be taking (like prescription drugs like Sharon mentioned) Good God, I lose my faith in people one by one.... Great article on a horrible story.

This is outrageous. I wrote an article on Abraham Cherrix' struggle (titled Hello, Judge Jesse Demps) last summer. There is something incredibly wrong with our healthcare system. Cherrix had unbelivable hurdles trying to forgo conventional treatment in favor of the treatment of his choice. I'm convinced the only reason for this ruling is because one brain cancer patient using marijuana won't result in the pharmaceutical companies making billions. Perhaps, they should remove all of the prescription meds on the market that actually do kill people.

Un-be-lievable. When the legislature is this thick, judges SHOULD step in and legislate from the bench.

Very good point has been raised here in your writing and I congratulate you. In my opinion every person should have the right to accept or deny treatment for himself/herself. But opinion seems to be divided on this issue among the policy makers and unless their is a consensus opinion it is difficult to reach a conclusion. Nash

Excellent article- outrageous case. How can the judge be so cruel as to let her suffer in the face of uncontroverted evidence that this is her only option? This is how good case law gets made- you carve out exceptions based on experience and need. My heart goes out to Ms. Raich.
