Sexually Active Georgia Teens Face Jail Time

In 2005, Genarlow Wilson, then a 17-year old high school student who was a talented athlete with good grades, was arrested for receiving oral sex from a 15-year-old girl -- who participated willingly.

The facts: Genarlow attended a New Year's Eve party with other teens at a Douglasville (GA) hotel in December 2003. The teens were partying, eg, drinking, smoking marijuana and engaging in sexual activity.

One teen even recorded some of the sexual activity with his camcorder, specifically, a 15-year old girl giving several of the boys oral sex. Yes, several of the boys!

One of the girls eventually told her mother what happened. She notified police, who then questioned the boys - six in all, Wilson being one of them. The boys were eventually arrested and charged with a number of offenses, including rape, sodomy, child molestation and contributing to the delinquency of a minor.

Five of the six boys who were charged accepted plea bargains. Wilson went to trial where he was convicted of aggravated child molestation. He was sentenced to 10 years in prison - in spite of the fact that the girl didn't press charges.

The Law Behind the Conviction

Essentially, the law that convicted Wilson goes like this: Under Georgia law at the time of Wilson's conviction, it was considered aggravated child molestation, which is a felony, for teens less than three years apart to have oral sex.

Rough Cuts with Michael Martin, an NPR.org journalist, said it best: "Georgia law is quite strict on what teens are allowed to do sexually even if there's a slight difference in age between the parties."

A conviction on the charge of aggravated child molestation carried a mandatory 10-year prison sentence. And, get this, if the teens had indulged in sexual intercourse, it was only a misdemeanor. What does all this mean?

If Wilson had had sexual intercourse with the 15-year-old, his maximum sentence could have been one year. Why? Because in the case of sexual intercourse, the judge has judiciary discretion. With aggravated child molestation, they doesn't. Why?

Did You Know?
In Georgia, if teeens are four years and two days apart, the older person is facing -- if it's a certain sexual act (sodomy) -- 25 years minimum in prison.

i dont think this was any reason to put a person in jail. haveing oral sex happens an they were doing it willingly. yall should be ashamed of yall selves for putting him in jail, its not right you not gonna put a 19 year old man in jail for getting head from a 18 year old female you not gonna put a married man in jail for getting head from his wife so why put a young man in jail for just getting oral sex from a girl who was willing to do it ....

I kept hearing people ask me why I wasn't writing about other cases such as Genarlow's, so I finally went into researching it (http://www.atlantamagazine.com/atl/article.aspx?id=6150). Now this case is not a right/wrong one for me. I think Genarlow, especially with all of the accomplishments he had going for him, should have known better than to be around when these two girls were giving head and having sex with all six of them. For her to wake up with only her socks on and nobody to go back for her or at least take her home, that to me, is so f--ked up. However, 10 years is a VERY long time for consensual sex. If I were the judge, I'd have put him on probation just because of the amount of people sexing that 15-year-old girl, but not jail time.

He wasn't stupid, he was horny. This is just another reason why the south should have burned. What a backwards thinking state. He did nothing wrong!

Hope he gets a pardon. He was stupid (and so was she) but stupid in this case shouldn't get you 10.

That's terrible and ridiculous. Wonder if it could have been racial too.Perhaps this is why he got sentenced so long and no retrial.I don't approve of his behavior but it was the wrong verdict.I hope he gets out soon to enjoy his young years and continue his education. There is a similar incident in Ohio but he was 17 and she was 16. It was consensual but the girl mother pressed charges.He's locked up for 3 years in a juvenile correctional facility. There are many cases like this. These kids need to be educated and the the verdict should be thought out carefully and be fair.
