The Real Cost of Freedom of Speech

Freedom of speech is the concept of one being able to give their opinion verbally in public with out the fear of being censored or punished. Yet do we truly have this freedom?

Freedom of expression is protected under the First Amendment of the United States Constitution but it does carry some exceptions like anything else in life, Mainly copywrite, commercial speech and the Miller test for obscenity, though rarely comes to play.

However to what extent can we claim Freedom of Speech? Walking along the road if you were to hear someone screaming racial slurs is this person safe from slander suits or defamation of character because it is their opinion? It seems our Freedom of Speech stops when it comes to minority issues, opinions of the government, opinions of things we are programmed to feel a certain way about. They are grey areas and people have been founded guilty of slander when stating opinions. This is only one scenario.

Peaceful protesting has been allowed for years. As long as you do not disturb the peace and act in outlandish ways. Though it sometimes may seems when the "right" person does not agree with a protest it is quickly broken up, arrests can be made, and sometimes brute force used.

As long as one does not touch on the 100 or so taboo subjects then they can express their freedom of speech but what may be taboo to you is a lifestyle for another. It seems now a days when someone uses this freedom to speak freely about there opinions and it has a chance to mold to many people they are quickly shut down. It is safe to say if your opinion is only reaching a limited few you are protected under the right of freedom of speech and can go about spreading your opinion.

I'm not so sure I believe in the freedom of speech unfortunately. You really have to watch what you say sometimes. Great article.

I have to agree that freedom of speech is changing and seems to be for those with the "accepted" point of view anymore, interesting article

The Don Imus case is a prime example. He got in trouble more for the fact that he was heard nationwide and his sponsors were afraid that people would backlash their anger against them. I recall some time ago when the WWE (pro wrestling promotion)used a storyline where a black manager using a pimp's personna brought in different women every week, usually Caucasian ones, who he referred to as "his ho's", yet no massive public outcry was raised then because pro wrestling is considered a caricature of sports and the user of the phrase was Black. That was every bit as demeaning to women as what Imus said, but Imus was an employee and Caucasian, while Vince McMahon owns WWE and he sanctioned the "ho" scenario.

Absolutely correct! I have one Web Site that was partly dedicated to getting the truth out about how the 9/11 events were organized by our own government, and about a month ago the Site was attacked and every piece of information was "wiped off", even the non-governmental info. My Site host claimed there was nothing wrong with the Site, so I knew they'd been told to deny what happened. When I threatened to take them to court, they restored the Site's storage capacity so I can try to rebuild it. Freedom of speech is still controlled by the Feds here.

Freedom of Speech is a relative term anymore. If you don't believe me read my article regarding Jim Zumbo and how his opinion shut down his entire life and livelihood. Spout off how much you hate our illustrious leader currently and see what happens. America has become so much like Orwell's story "1984" that I want to buy an island and move away sometimes. Except for the typo's I liked your article.

I do agree on some limitations on freedom of speech, such as speech that could do harm to others; your rights end where others begin, you know. But I do agree that sometimes subjects that are taboo get people in trouble not just with whomever they are speaking but with the government. Even with our freedom of speech it is possible to say the wrong thing. I do wish people would think before speaking, but I also wish people would think before responding, too. Having a different point of view doesn't mean you think all other points of view are invalid.

Having a child with Autism and being Wiccan I hear many state their opinions and I respect them until they carry it too far. At times I wish some whom choose to possess a closed mind would accompany themselves with closed mouths. Freedom of speech to an extent but harbor compassion and integrity along the path, as well.

You raise some interesting questions. I DO sometimes wonder if freedom of speech is only for those that spout the "accepted" point of view. I personally try to keep my mouth shut most of the time (although sometimes stuff just leaks out).
