Stern Drops Bid to Block Anna Nicole DNA Results
Anna Nicole Smith's longtime companion and lawyer, Howard K. Stern, has dropped his attempt today to block the release of DNA test results that could reveal the father of her baby daughter.
The results would have been released soon and he dropped his bid to stop the release when it appeared that a Bahamas court was going to reject his appeal.
An Attorney for Howard K. Stern withdrew
the challenge after a lot of skeptical questioning by the three judge Bahamian Court of Appeal.
The three judges all said that Howard K. Stern had filed his appeal too late and should have raised his objections before the Supreme Court had ordered the DNA testing. The testing took place due to a paternity challenge filed by Larry Birkhead.
Birkhead is a former boyfriend of Anna Nicole Smith who claims to be the father of Nicole's infant daughter, Dannielynn.
Justice Emmanuel E. Osadebay noted that Howard K. Stern had already agreed to DNA testing and waited a full week after the sample was taken to file his appeal.
Stern decided to challenge the ex-boyfriend's paternity claims because he said the dates didn't add up. In his affidavit, it was revealed that Larry Birkhead couldn't be the father because he and Smith's romance ended "well before the preceding 280th day from the birth of Dannielynn Howard Marshall Stern."
Stern also denies that Smith never lived with Birkhead at his home in California despite claims to the contrary.
Stern is listed on Dannielynn's birth certificate as the father. She was born in the Bahamas in September. The baby's DNA was tested on March 21 and the results have yet to be revealed.
On Tuesday, the Supreme Court of the Bahamas is scheduled to hold a hearing in the paternity case of Anna Nicole Smith's daughter. The lawyers and officials are prohibited by Bahamian law from discussing the case and even to reveal what the hearing is about.
Anna Nicole's baby, whose full name is Dannielynn Hope Marshall Stern, is set to inherit millions from the estate of Smith's late husband, J. Howard Marshall II. Anna Nicole Smith had been fighting the family of the Texas oil tycoon over his estimated $500 million since he died in 1995.
