Whether you are a student or a professional residing in the greater metro Boston area, or any city or town where owning a place of your own has become costly, you probably are renting a house or an apartment; either that, or you know someone who has or currently is. You are likely, then, all too familiar with the common conflicts that often arise between tenants and landlords. Having been a tenant, myself, in the Boston area for the last seven years now, I have unfortunately had to deal with many a dispute or negotiation with more than one landlord and judging from the response I tend to receive from others as I've discussed the issue in the past, I'm inclined to believe I'm not alone. Small claims court, tenant protection community networks and lawyers alike are presented with landlord/tenant cases all too often that deal with something typical like eviction to issues as obscure as one can imagine, like strange health violations in the building or some other seemingly impossible problem to try and get away with, that probably stretch as far down the line of ridiculousness as the realm of possibility may take it.

Takeaways
  • Most people are unaware of the many laws that protect the tenant or renter from losing money.
  • There are several measures a tenant can take before the security deposit issues gets to court.
  • New tenants should educate themselves all about the security deposit before signing a lease.

Ever had a bad experience regarding your security deposit? I'd be interested to hear about it, feel free to comment.

Great article. I'm a lawyer, and I get asked more questions on this topic than anything else. Landlords like to take advantage of tenants who don't know the law.
