Partial Birth Abortions Banned by Supreme Court

NATIONAL - In a 5-4 decision Wednesday, the Supreme Court approved what is being called a victory for anti-abortion activists today when its decision approved a ban on a controversial abortion procedure.

The controversial procedure that was banned is what many in the fight against abortion rights have dubbed partial birth abortion. This ruling is the first of its kind to ban a particular abortion procedure since legalizing abortions in 1973, without, according to the Supreme Court ruling, limiting a woman's constitutional right to medical abortion.

The ban on partial birth abortions only limits the manner in which an abortion can be performed, but does not prohibit other medical procedures for performing late-term abortions.

The decision was written by Justice Anthony Kennedy, who wrote that the ban does not contain an exemption for medical procedures for partial birth abortions, even in the event that the mother's life is in danger.

The original ruling in 1973, which legalized abortion rights for women, set up three very important caveats to the abortion laws. The first two are: 1) a woman had a right to choose a medical abortion prior to fetal viability 2) the state had the right to restrict abortion availability after fetal viability, as long as an exemption was available if the woman's life was endangered by the pregnancy.

Justice Kennedy wrote in his decision that the ban is nonetheless still constitutionally aligned, even without this exemption, since there are other methods for termination a pregnancy late-term when a mother's life is in danger. Unfortunately, many in the medical community disagree with this decision, since a doctor would be better educated and informed on the type of procedure needed to save a woman's during a high risk pregnancy.

In viloation of the Constitution huh? I don't remember the right to have abortions in the Constitution. As far as the life of the mother argument, it's not a good one for partial birth abortions. In partial birth abortions the baby is inverted so that it is delivered feet first . They are delivered that way so that the baby head is still inside the mother and most of his or her body is delivered when the baby's skull is fractured and his or her brains are suctioned out. Breach birth (feet first) is always more risky and potentially dangerous than a normal birth, so there would be no reason to perform a very risky procedure to save the life of the mother when a normal delivery would be safest.

It doesn't surprise me that Kennedy was the fifth swing vote in this case. I used to have very strong views on abortion, but after studying a few SC cases, I'm really starting to respect the pragmatic middle-ground approach of Anthony Kennedy (and Sandra Day O'Connor).

I sure agree with you Debra, I am too to glad this has been banned, it is hideous , ironic that a president who is so against abortion has no problem with captial punishment or war. Great article michy

I realize there are other alternatives. I looked them up on medical websites, pro life websites, and pro choice websites. Without getting graphic, I don't see how they are necessarily preferable to partial birth abortions, either in safety or procedure.

You write very clearly, and to the point, without favoring either side. I know other people have said this, but I just wanted to take a minute to point out how impressive I find it that you manage to write about a issue so controversial without straying from the facts of what happened. It's a shame more people can't get their news and information from people like you.

There is no exemption for the health of the mother because there are other options available. Women in states that already ban partial-birth abortions have turned to other procedures and turned out JUST FINE. The S.C. is not saying that a woman should have to die and carry that child to term... they are simply saying that this particular procedure is inhumane and should not be practiced. Great job covering this, Michy.

I would also agree that this was well written without a display of personal biasness. If only other writers were this objective, I would be far less cynical.
