Unusual "Murder by Duel" Charges Filed in Southern West Virginia

A 158-year-old Law Predating the State of WV is Used for the First Time in the Case of a Murder

WELCH, WV - Dueling...it's a crime we don't hear about anymore in our modern-day world. Yet, Steven Bryant Simpson Sr., 47, of Gilliam Bottom, WV has been charged with just that.

It all occurred on Friday, April 20, 2007, when Dana "Boo" Martin was using his ATV to help a woman move. He had, apparently, driven past Simpson's home many times and the noise disturbed Simpson so much that he confronted Martin in the road, where an altercation ensued, according to

 witnesses. That is when the two departed the scene to retrieve handguns. Upon returning, a shootout occurred and Martin, 39, received a torso wound. He was pronounced dead at Welch Community Hospital shortly thereafter.

McDowell County, WV prosecutors have charged Simpson, 47, with "murder by duel" on April 30. The law is older than the state of West Virginia and was written in 1849 by Virginia. WV State Code: 61-2-18 reads, "If a person fights a duel in this State, and in so doing inflicts a mortal wound, he shall be deemed guilty of murder. And if a person resident in this State, by previous agreement made within the same, fights a duel without the State, and in so doing inflicts a mortal wound, he shall be deemed guilty of murder in this State." West Virginia received statehood status in 1863.

According to McDowell County Prosecuting Attorney Sid Bell, it is not unusual to have an old Virginia law in West Virginia's state code. "We're not aware of it being used in McDowell County or any other part of the state," Bell said. "Our state code has annotations under each statute about when a case under it was brought before the state supreme court." Not only is it not believed to have been used in McDowell county, but also anywhere in the state's history, according to attorney William Sanders, Sr. of Princeton, WV.

Murder by dueling is a felony and carries the same penalties as first-degree murder, which is life in prison, according to State Trooper J.S. McCarty. Simpson was originally charged with possession of a firearm by a felon and was released on bond prior to the new, rare charges.

my name is tabitha east .. yeah your right someone needs to step and tell the truth...i was one of the people that martin was going to help move ...me and my mother had told mr. marin that we did not need no help..he said ok and went on about his self...dana had went around the bottom and and we heard a loud voice yelling back and forth....i told my mother that i wasnt going to let steve jump him...cause he was my slode friend....so we went around the bottom were the shooting took place .... e tried to prevent the sitiuation but we couldnt steve tried hitting mr matirn in the back when he tried to walk away....i think the simpson should be put away for life.....he has killed someone the time before this and got away with it....i think that it is totally wrong the way he got away with it.....but everyone had there ways...after that simpson yelled and said im going home and getting my gun u ......(used a racial word) .......after that they both went home and got a gun ... martin returned

As long as both parties are of sound mind it should not be any murder charges filed as long as both are of legal age;Really sorry about the familys lost.

This was quite an incident and a very unfortunate one for all of those involved. The law used to charge the survivor of a mutual shooting incident it seems would have been equally applied. One thing leads to another then someone ends up dead. It is a horrible fact that these things happen and that people would enrage each other in this way.

I do not know either person. I researched and got my information from the AP, CNN, and the Bluefield Daily Telegraph (all of which I cited at the end of the story). This story is more about the unusual charge that has been filed against Simpson than anything else. During and after the trial will be when the entire story will become public. Until that time, anyone reporting news has to go with official details.

annonomys you are right. martin ambushed stephen. he shot into steven's truck first. one bullet went into the seat and another went into the windshield. there are plenty of witinesses that saw the shooting.

And as far as being here to help somebody move, that is completely wrong. The people moved two days later because Martin was killed. If Martin were to stay home he would still be alive... Martin brought about his death by returning to the bottom where Simpson lived. I have only spoken to Simpson two or three times. I know nothing about him- and I have no reason to defend nor lie one way or another. I'm sure no fan of his, but the truth is the truth. If this is not Self-Defense, then what in the world is?

This article is completely wrong. Somebody needs to get the truth about what really happened. The truth is, Martin came into the bottom on a fourwheeler racing up and down on a paved road. Little children were playing. Simpson asked him to slow down and be careful around the children. Martin got mad and took a swing at Simpson and Simpson retaliated against Martin and beat Martin in a fight. Martin then said he was going back to his house to get his gun and kill Simpson. Martin had to go 5 or 6 miles to get his gun and left his fourwheeler and returned in an SUV and layed and waited for Simpson. And when Simpson pulled into another man's drive-way in a truck with another man along beside of him, Martin fired a few shots into the truck. Neither of the bullets hit Simpson nor the guy with Simpson. Thereafter, Simpson got out of the truck, returned fire and killed Martin.
