Per a public report on inmate information posted by the Los Angeles Police Department's West Traffic Division, the reality show star was pulled over around 12:35 a.m. After posting $5,000 bail approximately two hours later, Pennington was released. He is scheduled to appear at the L.A. Municipal Court on June 4th to face the misdemeanor charge of driving while under the influence.

In that statement, Pennington insists that "under no circumstances should anyone consume alcohol while driving." He also expressed remorse for potentially putting other lives at risk. The 42 year-old Marietta, Georgia native apologized publicly to the ABC network, and to his fans, claiming that the arrest was a result of an error in his judgment. "...We all make mistakes. However, this is accountability. I could have jeopardized the lives of other, and I am grateful there was no accident or harm done to anyone. This is my wake up call."

The star, who earned his graphic design degree at the Art Institute of Atlanta, began his career in modeling, and is considered the highest paid endorser---having landed print work for J.
