Robert Waggy was convicted back in 2000 for raping a 14-year-old girl at gunpoint. He accepted a plea bargain to relieve one of the charges of 3rd degree rape and was sentenced by Superior Court Judge Greg Sypolt to serve 41 months in prison, excluding the 217 days he had already served in jail, after pleading guilty to only one count of third-degree rape, and one count of second-degree child molestation. After the sentencing, Waggy realized that the terms of his bargain do not allow for him to have contact with his daughter and two stepdaughters, he filed for an appeal in May of 2002. Mr. Waggy who chooses not to have representation at his hearings made a request at the appeal to have the no-contact order removed. He was denied. On Friday, Robert Waggy filed the lawsuit against the State of Washington. Essentially, what Waggy claims is that by denying his visitation rights to his daughter the state has caused "parental alienation, intentional infliction of emotional distress, loss of love and affection and abuse." He seeks damages in the amount of 250 billion.
