Who's the Father? Who's the Uncle?

This is not a situation like Howard K. Stern and Larry Birkhead, each hoping that he is the father of Anna Nicole Smith's baby. In the paternity battle between identical twin brothers, neither one wants to be determined to be the father.

An ABC News article details the battle between twin brothers Raymon and Richard Miller. They are the father and uncle to a 3-year-old girl. The only problem is that they don't know which is which. The identical twins both claimed to have had sex with the same woman and, according to the woman, she had sex with both men on the same day, within hours of each other.

The woman, Holly Marie Adams, got pregnant and named Raymon as the father. He protested and demanded a paternity test. The test didn't help, however, according to ABC: results showed that both brothers have a 99.9% probability of being the father. Neither one wants to be responsible for paying child support. The results have produced several consequences: they've shown the limits of DNA evidence, they have produced a three year legal battle, they have led to a feud in the Miller family, and there is a little girl who may never know who her father is.

ABC says that Judge Fred Copeland has ruled that even though the DNA tests were inconclusive, Raymon would remain the legal father of the girl. In his decision, Judge Copeland said that he does not have to rely solely on the DNA evidence; he can also take into account the testimony of Adams, who, says ABC, believes "she can nail down the date of conception to a night spent with Raymon."

Raymon hopes to continue his appeal of the decision. "I want to go to the Supreme Court," Raymon told ABC News. "If they can't prove it's me then they should throw it out of court." And as for the child support, he said, "The state should eat it."

Copeland explained his decision to ABC News: "Look, she had a bunch of girlfriends to the rodeo and they got drunk and she went banging on Raymon's door trying to have sex. He says he did it reluctantly...but I can't imagine it was reluctantly -and that's when the baby was conceived I guess."

You sure are shallow. Why convict someone just because a female approached a guy for sex and he accepted. I believe there should be 100% proof that a male is the sperm donor related to conception, or the female should be held 100% liable for the upkeep of the child. If a woman is going to concent to sex with twin brothers, espically, within hours of intercourse wit the other, she should have total libility and responsibility for her stupity, and have to finically prove who the "baby Daddy is".

I had always wondered what would happen in a case like this. Why would the judge go with what the mother said, like she would somehow know? Not to mention she is quite possibly insane.

So what would happen if this was not about a child, but about a murder and both of them had the same odds of being the DNA match? Would both be convicted?? That is double jeopardy there... Who has the better of the two of sperm count, maybe one of them isn't able to have kids, and the other one is!! Maybe this is where they need to look to see who might be the true father.

Great article! I agree with Dreamweaver. That poor little girl. She's better off without either of them. As far as the mother, She's not that much better. One wasn't enough? She certainly couldn't claim she needed variety, their twins! The whole situation makes me sick.

I just feel awful for that poor child! A mother who would sleep with two brothers in the same day within a few hours... now I'm not trying to judge but... And then never being sure who her father is, and whichever one it is neither seem to be willing to accept the responsibility. That poor little girl!

I'm glad the court isn't buying his argument and is instead looking to other evidence, just as it would have in the days before DNA testing.
