Far too often, I sit listening to the rants of people on the television, radio, and read in the media the constant babble about how gays and lesbians have no right to marry because "God" says it is wrong. Frankly, I am sick of the same tired excuse that makes absolutely no sense given the laws of the United States regarding the separation of church and state.

At risk for angering many within the Christian community, it is time I have my say on the idea; they can either agree or disagree. It is not my problem any longer because in this country at this very moment, Bush and his administration have yet to ban or remove freedom of speech from our constitutional rights.

Unless history changed sometime between my years in grade school, college, college again, and the extensive amount of reading I do on a daily basis, the United States operates on the premise of separation of church and state. The reason this idea became law was so this country would not end up as those such as England and France where the person sitting on the thrown gave all the rights regarding justice to the church. Somewhat tongue in cheek, I can say that the founding fathers of this country knew this was a terrible idea and open to abuse. I am more Native American Indian than any other ethnic background so I use the term founding fathers lightly. Regardless, these great men that created the design that is now the laws of our country made sure the church had no political control above the people of the country. Citizens of the newly formed country had the right to follow the religion of their choice or even choose to support no religion at all. The separation of church and state did our country and its citizens a favor by allowing such freedoms those from England did not possess in the early days of this nation.

Takeaways
  • Marriage does not require clergy, only court documents and govermental officials to marry couples.
  • Separation of Church and State Still Exists
  • Marriage is a binding legal contract between two consenting adults
Did You Know?
If we consider the legalities of the marriage process, it is not illegal for gays and lesbians to marry; however, pressure from the church prevents our government from doing its duty by protecting the gay/lesbian rights to marry.

"normalize a decadent, immoral relationship" um... I know many in legally sanctioned marriages whose relationships I would consider decadent. Penalizing humans due to what is called sexual orientation is as wrong as penalizing humans due to skin color or ethnic background. None gets to choose what they want to be born to become. Exception to that is the religious persuasion that claims we incarnate in an earth life form so that our souls can experience a certain lesson for advancement of the soul.

Well said. JL Coolidge is the kind of person that does not know what the word democracy means and missed everything you said in the article. The government regulates everything about our lives from birth to death. We need birth certificates to declare a legal name and prove who we are. There are taxes on our estates after death. Die without a will and our heirs do not automatically get our hard earned stuff it has to go to probate court who takes a big chunk out of the value of what one once worked to own. Natives to the USA had their own laws and rules. Methinks they were better than current 'civilized' ones.

Good points and a good read...I think that the only legal marriage should come from "city hall" and should be open to all. Religious leaders should not be allowed to perform them, it should be a strictly civil function. Then, religious people could choose to have a ceremony that falls within their faith. I would add, don't feel bad about angering the religious, it is high time more people call them out for what they are and represent...

JL: You are speaking from a "church" point of view, not a "legal" point of view. Legally, there should be no problem with a male marrying a male or a female marrying a female. There is nothing immoral or wrong about love. How can love be a sin or a crime regardless of who is involved? Love is the epitome of goodness and if it happens to occur between two men or two women who are you to question the moral basis of that love? In other words, who died and left you the moral police? Love is love and since we live in the United States where there IS separation of church and state and the church cannot ordain a marriage then it should not be illegal and from a legal standpoint, it is not illegal and therefore should be something the government should acknowledge.

If two competent males or two competent females agree to involve themselves in a decadent, immoral relationship, that is their business. Expecting government to legally acknowledge and take steps to normalize a decadent, immoral relationship is more of an irrational act.
