I hope my researching this does not lead to the necessity of me using an attorney for a divorce. Hopefully none of us will ever need an attorney for a divorce of child custody case, but as we know we live in a society with an increasing amount of divorces.Prepaid legal services do cover divorce costs, but usually only if you buy the more expensive type known as comprehensive prepaid legal. Basic types cover handling simple issues, a minimal number of office visits, and maybe a one time representation in the court room. Comprehensive services often cover long term court room coverage and follow up office visits to the attorney. Following are the divorce and custody issues handled by a comprehensive prepaid legal service.
1) Filing for the divorce. This covers the initial paperwork and agreements set up by both parties.
2) Court representation. Any needed court appearance by the attorney are often covered in comprehensive prepaid programs.
3) Positive Divorce Resolution. This is a new term basically meaning divorce counseling. While this term might sound like an oxymoron, it helps the actual divorce proceedings go smoother, as both parties have come to some agreement about their affairs.
4) Contesting the divorce. If you wish to contest the divorce and you are the one with covered insurance, the comprehensive prepaid program might cover this.
5) Child custody agreements. Most of the time, this is done as a package deal with the divorce. However, sometimes addendums need to be done at a later time.
6) Seeking a ban against a custodial parent moving out of state. Recently, my son found himself in this situation. His ex wanted to move out of state with their child. He had no prepaid legal service and is paying dearly for an attorney.
7) Child support payment increases. If the custodial parent feels that there has been a reason to have the amount of child support changed, a comprehensive legal plan can benefit the parent. Often times, an increase in the parents salary will cause the judge to change the original court order.
