Four Senators Introduce Bill to Close Tax Loophole

Four Senators -- Barack Obama (D-IL), Dick Durbin (D-IL),Edward M. Kennedy (D-MA) and Patty Murray (D-WA) -- have introduced The Independent Contractor Proper Classification Act of 2007. This legislation is designed to protect workers and taxpayers alike from employers misclassifying their employees as independent contractors. This problem costs the government billions of dollars and denies the misclassified employees such things as overtime pay and worker's compensation.

When employers use this loophole, they are able to avoid paying employment taxes as well as workers compensation for the workers.
As a result, it is the misclassified worker who must pay higher taxes, because they are classified as self employed, even though they are not.

On the other side of the ledger, those employers who follow the rules end up paying higher federal and state payroll taxes. This puts them at a disadvantage against the ones who are misclassifying their employees and therefore have less expenses.

The Independent Contractor Proper Classification Act of 2007 will not only close the Section 530 loophole, but it will also allow the government to collect the taxes employers owe and it will also look at the need for more enforcement of the federal tax laws and the employment laws as well, with the aim being to identify the employers in our major industries who wrongly classify workers as independent contractors. It will also require greater cooperation between the two federal agencies that are most involved, the IRS and the Department of Labor when it comes to enforcing the law.

Senator Obama talks about the millions of Americans who go to work every day and play by the rules and the majority of employers who treat their employees the way they should with a decent wage and benefits. And the need to stop those who do not. He also thanked Senators Durbin, Kennedy, Murray and the members of the labor community as well as the trade associations for their support.

I work part-time for a small business which only employs "Independent contractors". We get no benefits, no overtime pay and have to pay our own FICA taxes at 15.3% and Fed & State Income tax also. My boss is a likable man & I don't begrudge him a profit but this particular profession does not pay well (without years of experience, which I don't have) and my small check is eaten up. At the very least businesses should pay their share of FICA (social security & medicare). The hours are perfect for me (my husband works days & I work nights) and I enjoy the work but I realize I'm going to have to start looking for another job. Those aren't easy to find when you want to be home with your children during the day and you have a disability.

This is to Paul and all others in the trucking industry. If the motor carrier you are leased to if forcing you to get work comp then they are cheating you. Work Comp is ONLY for the people you hire. It does not cover the boss meaning you. What you need is an Occupational Accident Policy which goes for about 1/4 the cost of Work Comp. And whether you realize it or not as an Independent Contractor you are allowed at least 276 legal business deduction by law that I can think of. If your state allows then get yourself an LLC and pay practically no taxes. Here is something for you to remember: " Anyone may arrange his affairs that so his taxes shall be as low as possible. He is not bound to choose the pattern which best pays the treasury, there is not even a patriotic duty to increase one's taxes. The reason behind this bill is simple. They(Democrats) want to make these independent contractors employees so that they can tax the hell out of them so that they can give the money to all the illegals.

I've been classified as an Independent Contractor for many years and it's wrong. I have to pay my workers comp myself and it's about to double. I pay for my own fuel, tolls and repairs to my truck. The company I lease to tells me where to be and at what time. I have NO employment rights or protection. The government IS losing out on millions of tax dollars every year. I really hope this passes and I'll do anything I can to help this bill pass.

If you (or the people who work for you) actually *are* contractors, you should have no trouble with this proposed legislation - it won't affect you in any way, other than requiring you to possibly provide additional verification of your contractor status, which you should be able to do with no trouble. If you (or the people who work for you) are "employees in contractor's clothing," employee rules *should* apply to you (in terms of both benefits and corporate obligations). Sorry, but I've been a true contractor for more years than I can count, and I just don't see what you're all complaining about.

this act will only serve the government, not the employee. i always did better being an independent contractor, 1099, because i could deduct my expenses. as an employee, i paid more taxes because i did not have any deductions.

You all have wonderful comments above and it is so true! It's interesting how they assume that the employers are misclassifying their workers. However, has it dawned on them that some individuals DEMAND to be paid as contractors? I own a small business and have no employees. I have yet to get a paycheck myself! There is one person here who is self-employed and I issue a 1099 for. I keep accurate records of everything. However, this person does not want to be an employee. She gets paid better by being self-employed ($20/hour) but better yet, she has total control of her job. She tells me what she will and will not do, what days she'll work etc. If this law passes and I am forced to convert her to an employee, I will have to close my business. I cannot afford the employment taxes, W/C, mandated health care, etc. and by losing her, I lose half my revenue. Thank you Democrats for allowing another business to fail. We'll be a third world country in no time!!!

Have you noticed how the Government seems to want large monopoly businesses these days. Remember when they used to break them up(AT&T)? It is much easier for the government to control a few large businesses than a whole bunch of small, independant businesses and this is just another move in that direction. It is not surprising that the Democrats are in bed with the unions they both stand for the same philosophy...take, take, take!!!

This legislation flies in the face of those who are, and wish to remain tax paying, independent, self-employed workers. There is nothing inherently wrong with a company using independent contractors if it is done by mutual consent. Further, if this arrangement does provide a competative edge to a client company, it is a win-win-win situation: for the client company that gets the work, the independent contractor who does the work, and the government that still sees the same tax revenue regardless of who writes the check. While abuses may exist, they are not universal, and any proposed changes to the law should include a provision to allow independent contractors to maintain that status if they so choose. Any legislation that paints all independent contractors with the same broad brush is simply wrong-headed. From my prospective, the situation is not broken and doesn't need to be fixed.

This turns a blind eye in a spin to the fact that they are screwing the self-employed in the first place. All this bill will end up doing is crush the entrepreneurs who are struggling to get their business going. It's very simple, if you work as a "contractor" you do so at your own will, no one is tricking you into it. You take the job knowing you'll be accountable for yourself. Instead of redistributing the taxes, they should be looking for ways to lower the self-employed taxes. Maybe by cutting some of the warfare welfare state spending... This really has nothing to do with helping the "little man" it has to do with making sure the government gets what it thinks is its "fair share". What a scam...

This is odd coming from the largest bunch of non-tax paying liars on the face of the earth. I am very opposed to this bill. If they want to increase tax revenues, close the southern border, fine employers who hire illegals, give the jobs back to the Americans. The illegals are certainly not paying taxes. P.S.
