Gray Rape - Should it Really Be Considered a Form of Rape?

Deciding who is wrong in a date rape can be a tough decision. Deciding who is wrong in a gray rape can be an even harder decision. I believe in some gray rape situations, but not all. Both people are to blame at some point. Let's say Paul and Susan meet at a party, get drunk and go back to his\her place and have sexual intercourse. They wake up the next day and Susan doesn't remember what happened very clearly, neither does Paul. She remembers telling Paul no, however, she did willingly go back to his house. This is called Gray Rape.

In the case of Paul and Susan I think they are both wrong. Neither of them should have been undergoing any sexual acts being that they were strangers. Both Paul and Susan should be held responsible because of that one factor. However, I think Paul is more responsible because of the old saying, no means no. He can't be entirely blamed for this either because Susan went to his house and got in his bed.Paul assumed because Susan was wearing a tight fitting outfit that she wasn't a virgin. Even if she wasn't, that doesn't mean she was willing to have sex on the first meeting. He also assumed that when she put up a fight it was just something that all girls do. Susan believed that it would be okay to kiss a stranger and that it wouldn't go any further than she wanted. However, being as they were at a party and alcohol was involved, neither of them can be too sure what really happened.

I believe that this type of event happens much too often. Who's to say who's to blame in this type of scenario? On one hand you can't blame the girl because she did say no. On the other hand you can't blame the guy because body language speaks just as loud as vocalization; going to a strangers home and making out with them can be interpreted in many ways. What they call grey rape is always a very touchy subject. How many times do college boys and girls attend frat parties with massive amounts of alcohol consumption? You can't keep your mind at total attention when you consume too much.
