Will Casey Aldridge Be Charged with Statutory Rape?

Jamie Lynn Spears' shocking announcement earlier in the week has people wondering: Will her 18 year old boyfriend suffer any consequences for impregnating 16 year old Jamie? For months the public has been looking on in fascinated disgust as her sister Britney is slowly self-destructing and leaving two small children in the wake of her emotional and possibly moral decline. Just as the snapping jackals of the paparazzi contented themselves with pumping her gas and wishing her a good night and a safe drive every time they had their fill of snapping pictures of Britney doing absolutely nothing, the Spears family once again provided ample fodder for the click happy mob: young Jamie's unplanned pregnancy.

Aside from the fact that the child is a mere 16 years young and thus a statistic in the making by virtue of another unwed teenage mom being thrown into the mix, the legal questions simply cannot be ignored: what was Casey Aldridge thinking (the answer what he was doing his thinking with having been answered satisfactorily) and will his infatuation with the beautiful teen land him in jail?

At the time of conception, the younger Spears girl must have been about 15 or 16 years of age and thus well below the age of consent. Therefore, any sexual intercourse is considered statutory rape, no matter how consensual it supposedly occurred. The philosophy behind the law being that a child of the tender age of 15 and 16 may have all the biological trappings that permit and even invite intercourse, but because of the emotional and mental age, the teen is not able to fully understand the full list of ramifications related to this activity. In other words, even though Jamie probably invited the advances of Casey, she was not legally able to consent.

If statutory rape charges were pursued in California, where the younger Spears girl works, Casey would most likely be charged with a misdemeanor under Cal. Penal Code § 261 (2003) and if convicted might be sentenced to about one year in state prison or county jail. Other possible charges may include molestation and, if alcohol was ever involved, child endangerment.

The latest I've heard is that the two may get married, so if Casey does go to prison for statutory rape then that would not be the best start to a marriage. Sophie

She is a young person. And maybe she didn't make all the right choices, and this was the result. However, dont you think that we as non celebrities have made mistakes as well. The only difference is that we have the option of privacy they do not. If your little sister came home pregnant, of course you would be upset. You may talk to her, yell at her, but it won't change the fact that there is an unborn child growing inside of her. You can't change the past, but you can help create a positive future. I don't advocate for sex outside of marriage, but i can't charge her either. What i will say is that she is in my prayers, and i hope that from this a lesson is learned. Allow her to live, we have all made mistakes, and were forgiven at some point. I think she already has beat herself up about enough. She wakes up every morning, and see's what happened after she made the decision to have sex. Have Compassion.

he cant be charge wit statutory rape unless the parents say it wasnt ok for them to have sex and they wanna put him in jail but who knows what the parents think.

u can kiss zoey101 goodbye...i cant believe shes pregnant! i think its the parents fault 2...they obveiously didnt get through to their kids on whats right and wrong! I really thought that jamie would be the one to save the spears' family reputation since brittney is slowly crushing it...i wish jamie turned out better...now the whole family is screwed!

Wow Jamie Lynn great move on getting pregnant. Knowing how you were a role model to kids from your show Zoey 101 they will now think that its okay to have sex at such a young age. Yup, great move.

Firstly, her parents would have to file the charges. I'm going to guess that it's more than likely they won't. The last thing the family needs is more negative media attention.

Well...that book can just go right in the trash now! :-) IF it ever gets published she will be laughed at...unless it tells of how her girls are reckless and the lack of parental guidance she played.

That is rediculous. He shouldn't be charged with anything, it's only because it's Jamie Lynn that they are discussing this. Everyone thinks she is so innocent.Um, alot of 16 year olds are having sex with men way above the age of 18.

I'd have to agree with taslol. My husband is actually 18 months younger than I am. So I was 18 and he was still 16? Is that statutory rape? I sure hope not. If I were jailed at that age, we might not have had the last, wonderful 13 years together. There are certainly cases where the statutory rape laws protect girls, but I don't think they're relevant in this case, especially if they were both minors when their relationship began.
