Bobby Cutts Trial: Jury Deliberates

According to different sources (The Associated Press, The Plain Dealer - cleveland.com, Akron Beacon Journal) right now jury is deliberating in the Bobby Cutts trial. The Bobby Cutts trial is being held in Canton ,Ohio. Bobby Cutts Jr. has admitted he killed his pregnant girlfriend and "disposed" her body. However, Bobby Cutts said during the trial that he killed accidentally his girlfriend Jessie Davis when he unknowingly put an elbow around her neck as tried to stop her form leaving their home.

However, the prosecutor (Dennis Barr) has another opinion and told the jury of the Bobby Cutts Trial on Tuesday that Bobby Cutts' story is a non sense story. Prosecutor Barr believes that the reason of Cutts killing Davis (and her unborn child) was mounting debt and child support for a fourth child. He just wanted an easy way out of his problem.

The ex-officer Bobby Cutts, from Canton OH, pleaded not guilty to charges including aggravated murder in the deaths of Davis and her unborn child. If convicted, Butts could be sentenced to death or at least life in prison without parole.

So now jurors have to ponder which hypothesis (the prosecutor's or the defence's) is more credible: whether the former police officer accidentally killed her or deliberately strangled her. Cutts´ defence asked the judge to instruct the jury of involuntary manslaughter or voluntary manslaughter instead of murder. The judge denied the defense request.

Cutts behaviour after the death of her girlfriend does not help him with his account of involuntarily suffocating her. Cutts testified that he wrapped Davis body in a comforter, put her body in his pick up, and dumped the body. He waited almost 9 days to tell the police were the body was while there was an intense search near Butts and Davi's house.

The judge that has the case, Judge Charles E. Brown Jr, sequestered the jury, and spent 2 hour reading instructions to them on the laws that apply to this case. The 12 member jury spent the night in a nearby Stark county hotel after delivering all day on Tuesday.
