Spain is a beautiful, romantic, exciting and culturally rich country that has a lot to offer couples who are getting married. Generally the marriage laws of Spain make it possible for non-Spanish citizens and residents to get married in Spain, however, it seems that some of the region districts of Spain interpret the marriage laws differently and they can prohibit non-residents from getting married. To avoid these interpretation problems, it is recommended that non-Spain citizens get married in Madrid.

Documents You Will Need

In order to apply for marriage license in Spain you will need several official documents. First of all you will need an application form. This form can be obtains from the Civil Registry in the Spanish district you plan to get married in. Next you will need an official copy of your birth certificate that has been Apostilled. This document will also need to be translated into Spanish. You will also need proof that you are legally able to get married. This proof needs to be in the form of a sworn affidavit that has been certified and Apostilled by an officer of the American Consulate.

A certificate of residency is also required. Again you can get this document certified at the U.S. Embassy or Consulate. If you want the banns posting requirement waived, then you will need a waiver form the U.S. Embassy or Consulate that states that the U.S. doesn't require banns to be posted and therefore you should be exempt from this. Finally you will want to bring with you proof of your divorce or proof of the death of a former spouse.
