The second Appellate Court of Los Angeles, California has handed down a ruling, which states that all children between the ages of six to eighteen must attend public school or an approved private school. This ruling takes away the rights of parents to home school their children in the state of California and there are no religious exceptions. The court is following a law, which was enacted by Adolph Hitler in 1938, which prohibited home schooling and required children to attend state schools. Yes, I make this comparison because this is the catalyst for any law which usurps a parent's right to home school.

Germany has recently started enforcing the 1938 law which was never revoked and many parents have fled to the United Kingdom in order to keep the state from taking custody of their children. It looks as though this phenomenon is spreading and has now hit the United States in the form of a California judge that has determined that the state is much better at educating your children than you are. This ruling is an obvious backlash to the outrage of parents over the passage of SB777. The backlash of that bill was that parents would opt to take their children out of California schools. Just as I predicted in my article, "Kaleeforneia Loses its Mind" the State is now starting to attack and force parents to enroll their children into state run schools, Zeig Heil.

You can probably tell that I am a little upset by the current situation. One of the problems is that they argued this case on the First Amendment to the Constitution which is easily defeated. They should have actually argued this on life, Liberty, and the pursuit of happiness. Some of us have been watching this country move in a down word spiral into fascist dictatorship. Very much, like Germany as the NAZI Party was on the rise, too many people sat idly by thinking that as long as it does not affect them, then it is no problem. Nevertheless, what affects your neighbor today will eventually work its way to you, and then it is too late because you are alone.

I am the GRANDMOTHER of 11 children. It terrifies me when I look at the any thing goes attitude our school systems have. The morals are very few. The TEACHERS that know and love GOD have to walk on egg shells. The way I see it , This Califorina ruling on home schooling is satans hand at work. If I had a final say so in the type of schooling my granchildren received , it would most definately include GOD. You see when we place GOD back into our childrens lives , we will not have to worry about homesexaulity, abortions,or any thing that is not morally correct. I also think that the Hitler statment is pretty close to being correct. We must began to stand up for our rights . The goverment controls to much of our lives especially where our children are concern. I really think we need to pay attention and began to speak up. I will be praying for the home schooling ruling in califorina and thru out our country.

This is scary. My children will never attend public school. My son is enrolled in an awesome private school for next year, and I've homeschooled him this year. With this curriculum, he's way ahead of public school kindergarteners in all areas. He is reading like crazy and doing math that I didn't do until 2nd grade. I do want him to have the school environment and social experience though.

We pulled our son out of public school, due to a variety of reasons: poor teachers, overcrowding, and hideous test scores. It was a tough decision, but the home schooling works well for our family. Both of us have college degrees and are able to monitor his progress effectively. We even use a great program through Abeka Academy. It seems heinous that they (in CA) can mandate your children be forced into a drug infested, violent/dangerous situation, when test scores and common sense prove home schooling works. Congrats on your cert and my hat's off to ya! Great article! Kim

typo - I meant it looks like they may get involved and "HOPEFULLY" get this taken care of. Sorry - doing a craft with the kids. Yes, I'm the ultimate multi-tasker. LOL :-)

Here's the HSLDA's update on this court case: http://www.hslda.org/hs/state/ca/200803030.asp --- It looks like they may get involved and get this taken care of. If I see anymore updates, I'll continue to come back and let you know. ~Momie~

Shocking, amazing, and horrifying. I hope this does not become a trend for other states!

Once again you expose an ugly truth. I wish you were wrong. I wish we both were. You're one of those that has not fallen asleep at the control panel of the American system, and I commend you for pursuing a career in education.

Nick's right about the scores of public school kids. Home school students outscore public school students by an average of 30 - 37 percentile points in all subjects. Here's some links to stats: http://www.hslda.org/docs/study/ray1997/04.asp, http://www.hslda.org/docs/nche/000010/200410250.asp, http://www.hslda.org/docs/study/rudner1999/Rudner2.asp. Home school students have consistently outscored both public and private schools. Education should be a top priority in this country. Unfortunately, it may not be. Based on the poor performance of public schools, as well as other factors, I had to make the choice to take my children out of public school and teach them myself. It turns out it was the right choice, the best choice I've ever made in my life. My elementary aged girls read better than most adults and were at a high school reading level the last time I assessed them.

WOW!!! Thank you so much for informing everyone of this decision! This just goes to prove what I've been saying for years - this is actually a communist country, and we are just being lied to. They say America is a free country, but it's just not true. Like you said in your comment, it's all about the money. It's sure not about the quality of education, because as you said, what they get in most public schools is substandard. The subject of evolution was taught in my Biology class in high school, but the teacher was a Christian. Outside class, he informed us that the only way he could teach evolution would be if a student asked him about it. So, all we had to do is ask! That's probably illegal, now. I'm so glad you're going to be a teacher. We need so many more like you. One more thing - many home schooling families are members of a home schooling association that has a group of excellent attorneys. Sounds like they are going to be getting a lot of business! Sorry this comment is so lo

Well, you call the government of California NAZIs? Is it because they are left - wing? If so, you are so true. A left wing government with a Republican governor. lol

Let me guess which court ruled in this case -- was in, per chance, in San Francisco? Nick, congrats on your CBEST! Just have the ACLJ on speed dial! They have won so many cases it's unbelievable! Giving the ACLU a run for their money, and I'm applauding them (and supporting them).

The only part of your article I would agree with is that America has been going down the road of corporate-fascism. As for home-schooling, I have long held that it isn't a good way to teach children. Of course there are exceptions, but for the most part it is sub-standard and dogma laden. And as pointed out, homeschooling is still possible, just regulated. And to compare the ruling with a Hitler dicate is disingenous and misleading. Hltler also built a very good highway system. By the logic of all is bad, if someone was suggesting a national push to rebuild infrastucturr would they be seen as being like Hitler? You can't cherry-pick to try to justify an illogical comparison.
