The Need for Child Protective Services Reform in the United States

Litigation is Our Only Hope for True Child Protective and Child Welfare Reform

Child Protective Services took my child in October 2004 based on false allegations. I had to fight to get her back and finally did, but not before Child Protective Services had caused great harm to my child and my family.

While there have been attempts at child protective reform in recent years, there has not been any meaningful child protective reform in the United States, but there needs to be. One of the biggest problems with Child Protective Services (CPS) is that child protective caseworkers spend too
 much time investigating false allegations and therefore are unable to investigate real cases of neglect and abuse. So we have the anomaly of innocent parents rotting in prison, while children still die from abuse.

The Center for Disease Control in Atlanta claims that there are three million child abuse reports made every year. Two million of those reports are without merit. What has created this situation?

Mandated reporting is the primary culprit. Doctors, nurses, teachers, psychiatrists and numerous other professions are required by law to report any suspicions of child abuse and neglect. If they don't, they can be charged with a felony and go to jail. So to protect themselves, mandated reporters report things that they wouldn't report if the threat of jail wasn't hanging over their heads.

We need to get rid of mandated reporting. We need to trust doctors, nurses and teachers to make the right decision when they suspect abuse and neglect. This would cut down on the number of baseless child abuse reports and give Child Protective Services the time and money to concentrate on real abuse.

I lost my son to false allegations. I cant belive how children are taken away from parents without a shred of evidence without proper investagation. dcfs social workers fabricate petitions to detain children. social workers run their own program in court the judge gave me overnite visits with my son. when i called the social worker to arrange times of pick up and drop off for my son the social worker tells me there wont be no overnite visits and i wanted to know why when the judge had said it would be okay she said she never got the minute order from court . and i had already told my son the judge gave him overnite visits with me. he was crying i was crying how could they do this nto families when we havent done anything wrong. to complain about what the social worker did to me stopping overnite visits i would have to wait until the next court date and was 6 month away. my son became very angry at me for things that were taken away from him. because some bitch let this pow

i hate this country me and my wife had our 2 girls kidnapped by wright co cps in minnesota 8 yrs ago based on a lie my older daughter told them. and our younger girl is in foster care til 18 they do it for money its called title 4 funding and its from the federal gov. each co. gets 4000 to 6000 dollars for each kid snatched and placed in foster care. the united states a free counrty ha ha ha ! i hate america blow it up please this country sux the big one!!@@##

Kimberly, I hope you will consider finding a lawyer who will file a lawsuit on your behalf. Contact the ACLU and other groups that might be able to help you in your fight. Good Luck!!

Definitly they need a reform. My husband and I are deaf and we lost our children due to false allegations. My husband cant read or write english like i can. I am still fighting them in courts and it has been 3 year battle to try to get 2 of my children back. Half of the time the interpreters show up. So they are not following the ADA law like they are supposed to. That adds to the time delays. 3 times the judge ordered the CPS to requnite my oldest daughter back to me but they try to find other things to put in their reports to prevent that so far they have been succeding but i am getting fed up with them. I have court on 4th and i am going to request a jury trial and also planning to go to the media. I already thinking doing nationwide media about this issue. its a big issue of discrimination of an handicaped couple with no proof of abuse or neglect on the children. They want to try to make money of of my children illegally.

I agree wholeheartedly. We need to have more Federal lawsuits. The foster children need to sue too. Only then will our Government listen

The trouble with a class action or Federal Lawsuit is no money for a Lawyer. Fighting CPS for three year's has really taken it's toll on family member's, physically, emotionally and broke. This rogue agency does everything in it's power to push people over the edge with their lies and deceit. Even Pro-Bono and reduced fee Lawyer's are not allowed to fight a government agency. even if the parent's qualify. This need's to change. Middle income and low income people don't have a chance up against CPS unless they learn the Laws themselves and fight back with everything thev'e got. The problem thought with that is the Family Court Judges deny every Pro-se motion a parent files. How fair is this? I wish there was a Lawyer out there somewhere, who would do a class action lawsuit against all the states put together. One who doesn't look for payment up front. One who despises the dirty deed's of CPS against the American family. Winning such a case would bring instant notoriety.

Also, research the ASFA and CAPTA acts. These are the real reasons why CPS has been let loose on the tax-paying public. Funding! Change the funding stream towards keeping families together and stop the sick, sick monetary rewards for offending social workers and CPS might actually protect the children who need it. Some states are already attempting this line of thought but it's probably to little, to late and this is due to the "I can do no wrong and I have zero accountability" mindset that's entrenched in life-long CPSrs. The federal and state govt' made these monsters and I'm afraid they have opened up a pandora's box.

Have you tried a federal lawsuit for civil rights violations under due process and family association? If any of the social workers involved lied, omitted, or exaggerated to your local CPS kangaroo court judge, their "immunity from prosecution" will be stripped from them by the federal judge. This is fact as my family has successfully stripped immunities from several offending social worker who decided to mess with the wrong family. We have taught these arrogant, self-serving slime (all women) that the legal world goes both ways. Next, we go after the judge! Case was dropped, social wreckers have "retired" early, and the offending county has now completely follows THE LAW to the T, all because of our lawsuit. In fact, others families have come out against the offending county and started their own federal lawsuits.
