Kim Moses Sued for Selling Joe Montana's Belongings After Breakup

Since the demise of the relationship between former 49ers quarterback and his ex-wife Kim Moses, there has been tension with the division of assets. The most recent allegations come from Montana and claim that his former wife had auctioned off personal effects and memorabilia without his permission, for a profit. These allegations do not come without merit, and have resulted in a law suit for Kim Moses.

The division of assets is rarely a pleasant experience. I know this first hand. Recently, after going through an ugly breakup, belongings were held hostage for monetary value. The funny thing was that these belongings were antiques that were being stored for a family member. My ex-boyfriend claimed that I owed him a ridiculous sum of money and would not receive the dishes until I paid him said money. I told him that he could keep my share of an expensive hockey card collection, extensive amounts of media and electronics, but he still did not realize that these antiques were indeed not mine.

To avoid this situation, clear guidelines should be put into place at the beginning of the relationship, in writing, regarding the ownership of said items that one is bringing into the relationship.

As well as quoting rightful ownership, partners should refrain from buying items together or going "half-half" on items. This increases tension should there be a breakup in the future.

At the time of the breakup, take the time to clear your mind and think rationally. I know that this may be hard to accomplish at the time but think about the results. From a breakup can come a friendship? When one is leaving the relationship ensure to do so on good terms.

Most of all, it is important to respect each other. When dividing assets think clearly about who it means most to - and try to assess the value and make it so each part of the couple receives the same amount of valued items. Consider that personal items should not be divided and the "leave with what you came with" rule should be adhered to.
